Terms of Service

1. Agreement to Terms

By accessing or using SendItPlease ("Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is provided by TechAppDev LLP, a limited liability partnership registered in Hyderabad, Telangana, India ("Company", "we", "us").

If you do not agree to these Terms, do not use the Service. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation.

2. Service Description

SendItPlease is a comment-to-DM automation platform for Instagram and Facebook. The Service allows creators, brands, and agencies to automatically send Direct Messages to users who comment a specified keyword on their social media posts.

The Service connects to Instagram and Facebook via official Meta Graph API and requires valid Meta Business Account credentials. We operate as a Meta Business Partner and are subject to Meta's Platform Terms.

Features include, but are not limited to: comment keyword automation, story automation, live automation, follow gate, lead capture, DM broadcast, analytics, and multi-account management. Feature availability depends on your subscription plan.

3. Acceptable Use

You agree to use the Service only for lawful purposes. You must not:

• Send spam, unsolicited messages, or bulk DMs to users who did not comment or engage with your content
• Use fake accounts, bots, or automation tools to generate artificial comments
• Use the Service to harass, threaten, or abuse any individual
• Violate Meta's Platform Terms, Community Standards, or Developer Policies
• Attempt to circumvent Meta's rate limits or messaging restrictions
• Use the Service to collect or process personal data in violation of applicable law
• Resell, sublicense, or otherwise transfer access to the Service without our written consent
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use the Service to promote illegal products or services
• Impersonate any person or entity, or falsely claim affiliation

4. Meta Platform Compliance

Your use of the Service is conditional on your compliance with Meta's Platform Terms and Developer Policies. Specifically:

• You must have a valid Instagram Business Account or Creator Account connected to a Facebook Page
• You must not violate Meta's messaging limits (~200 DMs/hour per account)
• You must not use the Service to send content that violates Meta's Community Standards
• You are solely responsible for the content of DMs sent through your automations
• You must maintain a valid Meta Business Manager account in good standing

If Meta suspends, restricts, or revokes your account or our API access due to your actions, we are not liable for any resulting service interruption and no refund will be issued.

5. Subscription & Payment Terms

Plans & Billing

• Free plan: no credit card required, no time limit
• Paid plans billed monthly or annually in INR (via Razorpay) or USD (via Stripe)
• Annual plans are billed upfront for 12 months and provide approximately 50% savings
• Prices are fixed for the duration of your subscription under our Price Lock Guarantee

Renewals

Subscriptions renew automatically at the end of each billing period. You will be charged on the same date each month (or annually for yearly plans). You can disable auto-renewal at any time from your billing settings.

Refund Policy

We offer a 7-day money-back guarantee for new paid subscriptions. If you are unsatisfied within 7 days of your first payment, contact us at senditpleasesupport@gmail.com for a full refund.

After the 7-day window, payments are non-refundable except where required by applicable law. Partial-month refunds are not issued on monthly plans. Annual plans are not prorated on cancellation.

Price Changes

Under our Price Lock Guarantee, we will never increase the price of your existing subscription. New users may be charged higher rates in the future. Price changes for new users will be communicated with at least 30 days' notice.

Taxes

Prices displayed are exclusive of GST. GST at applicable rates (currently 18%) will be added at checkout for Indian customers. Provide your GSTIN at checkout to receive a GST invoice.

6. Cancellation Policy

You can cancel your subscription at any time from Dashboard → Billing → Cancel Plan.

• Cancellation takes effect at the end of the current billing period
• You retain full access to your paid plan features until the period ends
• After expiry, your account automatically downgrades to the Free plan
• Your automations, analytics, and lead data are preserved on the Free plan
• We do not delete your data upon downgrade — only upon account deletion

To permanently delete your account and all data, go to Dashboard → Settings → Delete Account. This action is irreversible.

7. Intellectual Property

The Service, including its code, design, trademarks, and content, is owned by TechAppDev LLP. Nothing in these Terms transfers any intellectual property rights to you.

You retain ownership of all content you create using the Service — including your DM templates, automation configurations, and collected lead data. You grant us a limited, non-exclusive licence to process and store this content solely to provide the Service.

8. Limitation of Liability

To the maximum extent permitted by applicable law, TechAppDev LLP shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, goodwill, or business opportunities, arising from or related to your use of the Service.

Our total aggregate liability to you shall not exceed the greater of (a) the amounts you paid us in the 3 months preceding the claim, or (b) ₹5,000.

We are not liable for any actions taken by Meta against your Instagram or Facebook account, including account restriction, suspension, or removal, whether or not caused by your use of the Service.

9. Indemnification

You agree to indemnify and hold harmless TechAppDev LLP and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any third-party rights or applicable law.

10. Termination

We may suspend or terminate your account immediately, without prior notice, if:

• You breach these Terms or our Acceptable Use policy
• We receive a valid legal order requiring us to do so
• Your account is associated with fraudulent or illegal activity
• Continued operation of your account poses a risk to the Service or other users

Upon termination for cause, you forfeit any remaining subscription period without refund. Sections on intellectual property, limitation of liability, indemnification, and governing law survive termination.

11. Changes to Terms

We may update these Terms from time to time. For material changes, we will notify you by email at least 14 days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

If you disagree with a material change, you may cancel your subscription before the effective date and receive a prorated refund for any unused annual subscription period.

12. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of courts in Hyderabad, Telangana, India.
